Okay, the show takes on a certain amount of space to mount a show,
arranges for all the various elements that go into it, and contracts
with artists and other vendors to be on site for the event. Then,
through no fault on anyone's part, one vendor who has committed to be
there, and whose booth fees are part of the overall budget for the show,
is unable to attend. Now why would the show have any obligation to give
him his booth fees back? It's not like they can cut that much out of
their security or promotion budgets at that point.
If this came up a few weeks before the event the show might be happy to
check with any waiting list to see if someone else is interested in
filling the slot, but "just days" before the show? The only way to
regard a refund in that case is as an act of charity, a gift to that artist.
I don't know how long it was between Plymouth and Omaha, but Omaha had
at least another week to find a replacement, or maybe they were flush
and thought a gesture of that sort would be recognized and put them in a
good light. But the legal concept here is "force majeure" or "acts of
God", when those events happen there is no liability created on either part.
It's great if the organizers can help, and I would expect that most
shows are run by people who would try, but in this case there wasn't
anything to be done. Plaudits are in order for Omaha for going above and
beyond, but no attack on Plymouth is in order.
