You could also take a look at PhotoByte -- a similar business system
published by photographer Tom Zimberoff. A while back Tom was seeing if
there was interest in a new version of PhotoByte, perhaps a subscription
model. Personally, I found PhotoByte too constrictive in it's structure and
interface for my usage, and it does not include the extensive pricing
library that FotoQuote does. Keep in mind FQ gives you range with which to
negotiate a fair price. It doesn't set pricing.
So much depends on how the image is used, the estimated impressions and, in
this case, site traffic; and other, non-business factors, such as how well
do you know the organization? If they're friends, you may want to cut them a
deal, for example. Is the site commercial, or non-commercial? Local,
national or worldwide? Is it primarily editorial or is it a corporate site?
Is the background going to be used across the entire site, or just on one
page? Are both images in use on the home page, or somewhere on the inside of
the site? How long do they expect the images to be in use? Will they want to
edit them, or use them "as-is"?
All of these parameters affect the license price. The amount the company is
willing to pay you versus with how much you are willing to accept will
ultimately determine whether you license your work to them or not.
Attribution on any use should be a given -- it doesn't cost them a thing to
give you a credit and a link. But is that all your work is worth? What do
YOU think the usage is worth?
SmugMug's commercial download license has nothing in common with licensing
an image for use on a website. What you need are terms that spell out what
your client can use the image for, what size, what publication, for how
long, and for what consideration in return. It sounds like they just want to
use it on a web site, which is similar in scope to a print publication, but
with distribution differences. Both FotoQuote and PhotoByte have good
instruction on this point.
That said, for two images in use for a home page, or section page, at medium
size (300 x 250 pixels), for a local/regional site, you might be able to
negotiate a price of anywhere between $150 - 400 each for a 1-2 year term
for each image. More, if it's a key image on the home page, less if it's a
minor element. Fotoquote is very helpful in coaching you on what to say when
you negotiate. But ultimately, it's about reaching a comfortable agreement
between the two parties. FQ can also generate a licensing agreement, terms &
conditions, and all the boilerplate that goes with it. For $150, it's
probably worth the price in educational value alone.
