I found over a hundred instances of copyright infringement of my images in the first hour that I tried Google Image Search. Not once did I upload any of my images. I simply dragged images from Google searches into the new Image Search. I don't believe I gave up any rights by doing that based on the current TOS written in 2007.
An important part of the TOS states: "This license is for the sole purpose of enabling Google to display, distribute and promote the Services....."
They need that license for Google to work. If they are not allowed to display the content then there is no Google.
I am firmly against rights grabs as I protect my work as best I can, but I personally don't believe this is a case of a rights grab.
