I think the most reasonable answer is to look to what the big, visible
retailers in your state do. For example, Amazon has lots of attorneys
and a track record of refusing to collect sales tax when they don't
absolutely have to, and they charge sales tax on downloads in the state
of Washington. I believe there are five states where they charge sales
tax, but I have no idea if they charge the tax on sales that don't
involve a physical delivery in all five of those states. This doesn't
help in California, Amazon refuses to charge sales tax there on
anything. But surely there is some California company that is fully
lawyered up, has faced the question, and has a website. If they charge
the tax, you can bet that the law requires it.
